Estate Planning

Proper estate planning includes maintaining control of your assets during your lifetime; planning for possible disability; distributing your assets to whom you want, when you want and how you want at death; and achieving these goals in the most cost effective and tax advantaged manner possible. Successful estate plans should have current planning documents including:

Last Will and Testament: Also known as Simple Will, this document names the person who is responsible for handling your affairs, as well as who should receive your assets upon death. You should also appoint a guardian for minor children in your will.

Revocable Trust: Typically used as a will replacement, a revocable trust allows clients to reduce settlement costs and maintain privacy by avoiding the probate court process, plan for disability, control the distribution of estate assets to designated beneficiaries, and reduce or avoid estate taxes for married couples, if necessary.

General Durable Power of Attorney: Also known as Financial Power of Attorney, this document gives people you select the authority to manage your financial affairs in the event you are unable to do so yourself. The authority can become effective immediately, or if preferred, only upon incapacity.

Health Care Power of Attorney: Sometimes referred to as Health Care Proxy, this document gives people you select the authority to make your health care decisions during any period that you are not able to do so yourself.

Living Will:
A Living Will is a declaration that advises your family and physicians that you do not wish to be kept alive by artificial means if you are in a terminal condition or permanently unconscious state. It allows you to make this decision while you are in good health so that loved ones have your clear instructions when faced with making critical decisions.
